Zhou, Lan: The theoretical difference between constitutionalism and democracy
周岚(Zhou, Lan)
The problems to be solved by constitutionalism and democracy are not the same;
The constitutional government must solve the problem of the scope, size, and boundaries of political rights. The method is to limit and restrict political rights by dividing civil society and the state, economic and cultural fields and political fields, private life and public life;
What democracy needs to solve is the legality of political rights and who is in charge. The method is to establish equal political rights for citizens, to generate state power through elections of citizens, and to restrict and supervise this right by citizens.
The opposite of constitutionalism is centralization, and the opposite of democracy is autocracy.
There is another important theoretical difference, which I will discuss in detail later: Constitutionalism mainly satisfies people's demands for freedom, while democracy mainly satisfies people's demands for equality.
