China must practice the separation of powers
----We urge turning China into a country ruled by law

On August 28 2012 around 11:00 am, nearly 200 China Democracy Party (CDP) members gathered in front of the Chinese Consulate in New York and held a protest rally. CDP members advocated practicing a democratic political reform and implementing the separation of powers! Wang Jun, the Chairman of CDP and the president of China Democracy Journal, attended the rally in the morning and made an important speech.

Chinese Communist Party monopolizes the political power and implements long time dictatorship in China through this monopoly, it also utilizes its monopoly political power to control economic resource, and even control the Chinese people’s ideology as well as election results. From Beijing Communist party chief Chen Xitong to Shanghai Communist party chief Chen Liangyu, and today’s Chongqing Communist party chief Bo Xilai, all of which were accused of involving in corruption. Each of these cases had led to a political storm, and the communist government did not try these cases under a fair, just and open judicial procedure. At the National People’s Congress in March 2011, the head of China's Congress, Wu Bangguo claimed “Six things we will never do” principle, one of the six things is that “never practice separation of powers and bicameralism”. “Separation of powers” is the basic political system of the most democratic countries around the world. The core of the “Separation of powers” is that the legislative, judicial, and executive powers are independent of each other, mutual checks and balances. The implementation of the “Separation of Powers” is that the legislative, judicial, and executive powers belong to three government agencies of the same status, in which they restrict each other. The “Separation of Powers” is the most widely accepted democratic political system. From Wu, Bangguo’s talk, we can infer that the Chinese government refuses to practice “Separation of Powers” in China.

The chairman of China Democracy Party, the president of China Democracy Journal, Wang Jun made a speech in the rally. He said that under the one-party autocracy, there is no separation between the Party and the government work, and the relation among the legislative, judicial and executive agencies is confusing, they impact each other, and contradict with each other. The biggest problem of China’s society is the problem of ruling by law, in the current Communist government, the “power” and the “officials” are not restricted by law, all the powers are above the Constitution; the officials are imperious, they get involve in power-for-money deal and corruption, which lead to the longtime unfairness of the distribution in Chinese society; the rule by law is replaced by the rule by man. Laws and regulations are of no use to government officials and those who are powerful; the so-called constitution is only used as a tool to govern ordinary people. In Chinese Communist Party’s officials’ words, the government is the law, and the officials’ words are the ordinances. Facts have proved that China needs an independent judicial system, and China must be ruled by law, the power must be ruled by law, the officials must be ruled by law, and the law is not simply a governing tool.

Wang Jun pointed out that practicing democratic political reform is the common aspirations of all Chinese people, and it’s a historic opportunity, we hope Chinese Communist government understand the situation, don’t missing the opportunity, and goes with the tide of historical development as well as practicing democratic political reform. Only by the separation of judicial, legislative, and executive powers can changes the rule by man into the rule by law, and elect the government and officials by the people. Any Party must execute the political powers on condition that guaranteeing the interests of the nation and the people. And only by this way can make the people to be the master of the country, and guarantee people’s human rights and freedom; improving people’s living condition and promoting the country towards prosperity, which is conducive to the unity of all ethnic groups and national unity and stability.
