Zhang, Linjing: The Power of Chinese Communist Authority Surpasses the Constitution
In China the actual headway of law is unsuccessful. Although many laws have been made, because of political corruption and judicial corruption prevailing, the individual rule habit of judiciaries is deep-rooted and makes laws abate greatly in the implementation. The status of individual rule is quite general, the laws making mostly aims at the ordinary people, namely “ruling the people by law”, and laws which are able to indeed restrict all levels of governments and officials are inadequate and even more distant from a constitutional government. Although there existed the Constitution before, due to Chinese Communist Party surpasses the constitution and the power of ruling party is above all without any restriction, the Constitution doesn’t have majesty at all and civil rights stipulated by the Constitution can’t be fulfilled sometimes. Additionally, the judicature can’t be independent and there is no examination system for violation of the Constitution, the political power may follow its inclinations and run wild without scruples. This is exactly the essential reason that the corruptive phenomena can’t be stopped by repeated banning and are more and more intense. From publicly exposing cases of corruptive officials, it is sufficient to see that the power without restriction can indulge in willful persecution to what kind degree.
Therefore, it may be seen that how today’s China need democracy, law and constitutional government.
