A judicial leader in mainland China, at a legal seminar, threw out a strange theory that the CCP is both under the law and above the law.
His argument is that the Communist Party must operate within the scope of the Constitution and the law, so the Party is under the law and accepts the constraints and regulations of the law.
However, he also believes that because the Communist Party is the ruling party and the core force leading the country, the four basic principles of the Communist Party will never change, but the law can be changed.
The party can propose to make laws, abolish laws, or propose amendments to laws. In this sense, the Communist Party is above the law.
This statement is really a gangster logic.
As a political organization, the Communist Party is either under the law or above the law. How can it be both under the law and above it?
This argument is essentially to tell people that the Communist Party can be lawless and its will is the law.
Therefore, China needs to build and improve the legal system. Only with a real legal system can the interests of the people be fundamentally protected.
