In fact, the contradiction between civil rights and state power is an old issue discussed in constitutionalism.
Since the emergence of modern constitutions, the contradictory relationship between civil rights and state power is the most basic constitutional relationship.
The fundamental purpose of constitutional government is to protect the basic rights of citizens, limit the state's wanton infringement of citizens, and achieve a certain balance between the two.
In the modern constitutional system, the confrontation between civil rights and state power has always been resolved and balanced within the framework of the rule of law.
If this balance is broken, the fairness of constitutional government will be subverted, the contradiction between civil rights and state power will inevitably intensify, and conflicts between officials and people will evolve into vicious events.
In today's China, the basic rights of citizens as stipulated in the constitution cannot be guaranteed, which has led to antagonism between officials and the people, conflicts between the police and the people, chaos in social security, and the collapse of the government's credibility.
